Another question for lawyer types
« on: July 15, 2009, 10:52:24 AM »
My wife's birthday is coming up and as it is a milestone one, I have been planning a surprise party for months.   Will have upward of 60 people at my house on Saturday.  Done a lot of work to get the house and yard ready in anticipation of the event.

Come home yesterday and there are red dots painted across my front lawn and little red flags planted in each.   No notice or explanation, just the dots and flags.

Was told today by a neighbor that the cable company, Mediacom, has now decided to put cable in the neighborhood (after opting not to at the time it was being built).   So they're going to start tearing up my fucking yard to run underground cables.  And they'll start tomorrow.

That means that on Saturday my lawn is going to be shot to shit and there will likely be equipment parked around.

Don't I have some say in this shit?  Can they just arbitrarily rip up my yard after I've spent months and money on the lawn?

I don't even WANT their shitty cable.  I'm perfectly happy with DirecTV.

If there is a utility easement, then they are free to work there at will (unless you can show some extreme nuisance situation).

Have you got your lot survey handy?

I agree, if they have an easement = you're fucked.

Charter did this to my parents' lawn about a year ago.  They had easement and everything else they needed to do whatever they wanted.  My dad is a front lawn guru, so to say he was ragingly pissed is an understatement.

The Charter Mexicans came on the day they said they'd be there, and they finished by the evening.  You couldn't tell where they dug up the grass at all.  There was one small line of brown dirt about a foot and a half long, but that was it.  It really was impressive how well of a job they did.

I yanked up the red flags and rubbed out the red dots.

They're not digging my fucking yard up this week no matter what they say.

"Hey my friends are the ones that wanted to eat at that shitty hole in the wall that only served bread and wine.  What kind of brick and mud business model is that.  Stick to the cart if that's all you're going to serve.  Then that dude came in with like 12 other people, and some of them weren't even wearing shoes, and the restaurant sat them right across from us. It was gross, and they were all stinky and dirty.  Then dude starts talking about eating his body and drinking his blood...I almost lost it.  That's the last supper I'll ever have there, and I hope he dies a horrible death."

The problem is, if they have an easement they have the right to do it, regardless if you rip the flags up or not.

I will make it difficult until after this weekend.  You can count on that.  They're NOT digging in my fucking yard before Monday.

I supposedly have an 8' Utility easement.  I'm trying to find out for sure.  So I measured.  If you go from the street, that's really in the middle of the sidewalk and nowhere near where they painted all these fucking dots.

Oh yeah, this will be fun.

Yes but a utility easement is "usually" from the end of the road easement.   Two lane road easements usually are 30' from centerline of road.  So saying all that try measuring 38' from centerline of the road and see where it puts it.
