Title: Houston, We Have A Problem

I know most of you aren't into professional sports, so I understand if less than 2 fucks are given.  But it must suck to be a fan of Houston's pro teams lately.  The Astros are a bunch of sign stealing, dirty, rotten scoundrels.  The Rockets traded away err'body, are 11-28 and currently on about a 16 game losing streak.  The Texans shipped JJ Watt off and now, the toast of the town, QB Deshaun Watson, not only is demanding a trade, but just got 3 sexual assault suits filed against him, and they are expecting 6 more to be filed shortly.

Good times.  Yeah, good times.

Lawyer question. Is there anything to be read into that these are civil complaints and not coming from the District Attorney's office? I'll hangup an lissen.

I am not per say legally degreed but I can assure that no one else knows very much about the laws and heretofore and whatnot.

Civil complaints can be constituted as such by virtue of legislative conservancy and a judicial decree.

Pursuant to these bylaws and covenants, I would recommend the District Attorney to lope my mule.

Distinct difference in civil and criminal.  In the civil cases, it's usually one party suing another for money damages.  For criminal, someone would normally make a report to the DA's office and the DA would decide if there is enough evidence to prove the elements of the crime to charge the other party.

My standard answer when asked "can i get sued for this" about a civil matter:

Anyone can sue nearly anyone for nearly anything.  It's up to the defendant to argue his/her/its way out.  You might, but most likely will not, be able to recover your attorney's fees and cost.

My standard answer when asked "can i get prosecuted for this":

Fuck if I know.  Depends on the DA, the evidence and the Judge's intestinal health that day.  Don't fuck around and find out.

Sound advice.  I found out early on when I was doing some appointed criminal work, that if the State decides to pursue a case, it truly is theirs and theirs alone.  

Ground breaking info there, Captain Obvious.

However, I was representing a lady who had slapped a bitch.  The other lady "pressed charges".  Again, the DA said yeah, we have enough to go forward.  We got to trial and the slapee said she didn't want to go through with it.  She had a change of heart and didn't want to testify.  I thought, well I'm a damn good lawyer.  Won that case.  The prosecutor said we have witnesses and we're ready to call the first one.  

Well shit.

So the lesson here is 

1) don't play the racism card
2) don't demand to be traded
