Second attorney for Toomer's tree suspect wants out

AUBURN, Ala. --- The second lawyer appointed to represent the man charged with poisoning two oaks at Toomer's Corner at Auburn University has asked to be let off the case.
Jerry Hauser filed the withdrawal motion Tuesday morning.
Hauser is representing Harvey Updyke who is charged last week with criminal mischief for the poisoning of the two iconic trees.
Hauser claimed in his request that he has a conflict of interest in the case because his wife is the Head of the Department of Communication and Journalism at Auburn University.
Updyke's first attorney, Phillip Tyler, filed a similar request the day he was appointed, which was granted.

I am surprised some big name bammer grad attorney has not offered to defend him pro bono in hopes of getting those big unmarked envelopes full of non-sequential bills slipped under his door. If his clients are all bammer fans anyway, then he should not suffer any drop off in his practice, right?

Theres not anything much in it to take it pro bono. Few attorneys ever do that. Folks don't routinely pay their own legal bills, let alone those of another. Despite what you hear from bammers, only to a select few is Updyke any kind of hero, and those that think he is are poor white trash. Appointed legal defense isnt a huge taxpayer burden. Court fees and such cover most, and if he pleads guilty he can be ordered to pay his appointed attorney fees.
Theyll find a Montgomery atty to take it, or the judge will order some poor soul to do it with the promise of many more casez appointed as a thanks.

AUBURN -- Harvey Updyke will have a preliminary hearing in the Toomer's Corner tree poisoning case on March 2 in District Court in Lee County, according to court papers filed Tuesday, a day in which yet a new defensive attorney was assigned to the case.
Updyke's first two attorneys filed motions to be removed from the case, citing a conflict of interest with Auburn University.
Updyke's new attorney is Jerry M. Blevins of Montgomery, according to court papers.
Updyke was arrested Feb. 17 for criminal mischief. Police believe Updyke poisoned the trees at Auburn in the fall after the Tigers beat Alabama in the Iron Bowl. The poisoning focused attention on the Auburn-Alabama rivalry because Updyke is an Alabama fan.
Updyke is free on $50,000 bond.
His second attorney, Jerry W. Hauser, filed a motion Tuesday morning to withdraw as Updyke's court-appointed attorney, citing a conflict of interest. His wife, Dr. Margaret E. Fitch-Hauser, is the head of the Department of Communications and Journalism at Auburn.
Updyke's first court-appointed attorney, Philip Tyler, was removed after he filed a motion to withdraw, also citing a conflict of interest.

No difference in education but the tuition went from $175.00 per semester hour when I started...to over $400.00 per by the time I finished. They got sanctified and certified the year after I left. Did me no good. Screw em'.

Many many moons ago, when I lived in Monkeytown, the Montgomery Academy used to have a Christmas basketball tourney and a regular participant was from just south of teh gumps on 331. Snow Hill Institute of Technology. Their shorts had the SHI down the side but the T was cut out.

When I was fresh out of Auburn in Aerospace a guy who just graduated from Embry Riddle in Daytona sat across the hall from me at Lockheed. He loved to tell about his superior Aeronautical degree because it came from an all Aero school. I told him, "Wow! You must have gotten a much better job than I did!" He didn't really get mad until I asked him how much his student loan payments were. That was good times.

MONTGOMERY, AL (WSFA) - The petitions for recusal continue in the Auburn tree poisoning case.
Just a few hours after the court appointed a third attorney to represent Harvey Updyke, the man accused of poisoning Auburn University's famed Toomer's Corner oak trees, another attorney has request to be dismissed from the case.
The first two attorneys sought release from the case citing conflicts of interest.
Lawyer number three, Jerry M. Blevins, an "irreconcilable conflict" as his basis for dismissal from the case, but specifics surrounding the petition have not been released.
Harvey Updyke's preliminary hearing is set for Wednesday, March 2 at the Lee County Justice Center.

No doubt. True story here (Unlike all the others I tell) my last semester up there, I took a Federal Evidence class as an elective under Fowler (Gun toting ex-POW by the way) and he spent the first part of every class bringing in former students to talk to us about preparing for the Bar and starting up in practice etc. Great stuff, but one night he brings in this one former student to talk to us. This guy is black. Colonel Fowler is introducing him and singing his praises and then blurts out, "Grew up right here in Monkeytown".
My buddy and I could not stop laughing as we kept waiting for the guy to go..."And every day, I would take that study guide for Contract Law and...BITCH, DID YOU SAY MONKEYTOWN???"

Hey all you esquires out there... can they MAKE this guy have an attorney? What if he tells this one to fuck off too? Can the court order him to accept appointed counsel? I know he has the right to defend himself, to act as his own attorney, but still... as redneck as this guy is, I am not sure this attorney will work out well either.
On the other hand, if he represented Langford, he obviously will put up with a lot in order to get the publicity.
