I hate hate crimes

So called "hate crimes" are discriminatory to me. If someone breaks my nose because I'm straight, gay, green or have such a large penis(which is the more likely scenario)--it makes no difference, they still broke my nose. IMO, the penalty should be the same. I just don't get the justice in stricter penalties for someone because they are somehow different from the norm. Actually, what was once considered different from the norm seems to be the norm.

MOBILE, Alabama -- Mallory Owens went to the emergency room early this morning, complaining of head pain, dizziness and disorientation stemming from the Thanksgiving beating that left her with skull fractures and crushed bones.

"I think she was released too early," said Kristi Taylor, Owens's mother. "She has a lot of head trauma."

Owens was released from the hospital on Monday and has no health insurance.

According to Taylor, her daughter suffered a small brain bleed and a severe concussion after witnesses said she was attacked by Travis Hawkins Jr. after Thanksgiving dinner at his parent's house.

Owens was celebrating with the family because her girlfriend, Ally Hawkins, is Travis Hawkins Jr.'s sister.

After the attack Owens was treated at the University of South Alabama Medical Center with multiple skull fractures and crushed bones. She had to get metal plates put into her cheeks and will have to consult a plastic surgeon because of her injuries.

The Hawkins family said Owens was staying at the Hawkins home -- which was also the scene of the attack -- immediately after she was released from the hospital. Owens is now staying at her apartment, according to Taylor.

Travis Monroe Hawkins Jr., 18, was arrested and charged with second-degree assault on Nov. 25, 2012.

Travis Hawkins Jr. was arrested Sunday and charged with second-degree assault. He has since been released on bail.

People across the nation have called for more serious charges against Travis Hawkins Jr. A petition on Change.org with nearly 90,000 signatures says the severity of Owens's injuries should at least point to attempted murder.

However, Mobile County District Attorney Ashley Rich said second-degree assault fits the facts of the case.

"In attempted murder, we have to prove he [Travis Hawkins Jr.] intended to kill her [Owens]," Rich said. Evidence, including witness and victim statements, does not indicate intent to kill, according to Rich.

"There's no doubt he intended to injure her," Rich said.

Doctors told Taylor her daughter will continue to experience dizziness and ringing in her ears as she recovers from her concussion.

"It's been a whirlwind, I'm dazed," Taylor said. "We are so grateful for all of the support we've gotten from the public. It's overwhelming."

Yes, but you can afford the Cochran firm. I would be depending on the free representation so I go for less vital body parts. Kicks to the nuts and such. Manslaughter at the worst with nut kicks--according to the appointed rep anyway.

You can get that reduced down to involuntary.

I didn't see how this was a hate crime.  Because she's a lesbian?  I did not see that her being a lesbian was the reason he beat her, so why is it automatically a hate crime?

I didn't see how this was a hate crime.  Because she's a lesbian?  I did not see that her being a lesbian was the reason he beat her, so why is it automatically a hate crime?
I don't think that it was charged as such. I don't know if we have hate crimes in Al--other than federal. But there was a petition to charge the dude with attempted murder, which I gathered was from the homosexual community--simply because she was a lesbian. If the sister had a real "boyfriend"and the brother had beat his ass, there would not be a petition to up the charges. Even if he did punch her face because she was a lesbian, I don't think the punishment should be any different. The punishment should fit the crime, not the victim. It's BS to me.

This has irritated me for years. Normal people just get normal murdered, but special interest individuals get hate murdered.... As I have always told my kids, DEAD IS DEAD. But they are taught gay dead is different than straight dead?????

We do, part of it was authored by a guy I went to high school with who is now a Senator in Montgomery (Marc Keahey).  His sister is a lesbian, somehow that doesn't get mentioned a lot when he's hitting all the Pentecostal churches back home campaigning.

MOBILE, Alabama -- On Thanksgiving, Mallory Owens was beaten by her girlfriend's brother, Travis Hawkins Jr., after Thanksgiving dinner at the Hawkins family home.

There has been debate over what sparked the attack, with many speculating it was prompted by Owens' relationship with Ally Hawkins, Travis Hawkins Jr.'s sister. Ally Hawkins herself said it stemmed from heavy drug use and prostitution by the couple.

Today, Owens released a statement through the Gay and Lesbian Alliance Against Defamation. In it, she doesn't address allegations of drug use or prostitution, but she does talk about what made her stay in the Hawkins home after her release from the University of South Alabama Medical Center on Monday.

Official Statement from Mallory Owens and Family

I am represented by attorney Christine Hernandez. I am supported by my family, friends, several organizations including Equality Alabama and GLAAD as well as numerous other individuals who have offered a multitude of support to myself and my family including all of those that have donated to help me with my medical expenses. For all of you that have supported me, I am very grateful.

The last week has been the most traumatic several days I have ever experienced, physically, mentally, emotionally, and spiritually. Not just for me, but for my family as well. Fortunately, we are a strong family, and we are sticking together as a family.  On Thanksgiving Day, I visited the Hawkins' home, the family home of my girlfriend Ally Hawkins. As I was leaving, I was brutally attacked by Travis Hawkins Jr., Ally's brother. I believe that he intended to kill me. I was defenseless against him. This was not the first time Travis Hawkins Jr. attacked me and sent me to the hospital.
 
Travis Hawkins Jr. has been charged with Assault Second Degree by the District Attorney's office. Although, I appreciate all the efforts of the hospital and EMS staff, police, all the investigators, and District Attorney Ashley Rich, neither I nor my family agree that Assault Second Degree is the right charge. We are very hopeful and optimistic that as Ms. Rich, her office and the police continue to investigate this crime, that the charges will be upgraded to attempted Murder. I was unconscious when the beating ended. I do not know what stopped him. I do know he has threatened to kill me before, he has attacked me with a metal pipe before, and on Thanksgiving Day he launched an unprovoked attack on me that left me unconscious, hospitalized, suffering horrific head trauma, severe injuries and in need of surgery and additional treatment. Since the attack, Travis Hawkins Jr. has been seen following my family and appearing at locations where they have gathered. He has threatened to finish me off. I believe as long as he is free on bond that my life continues to be in danger. Even beyond the physical harm, I am quite traumatized. I am afraid and I feel that I have been victimized repeatedly by the Hawkins family.

The interview at the Hawkins home was not requested by me, nor was I aware that the media would be at the Hawkins home. I was brought back to the home by Ally Hawkins. I wanted to be in my own apartment. Mr. Hawkins Sr. insisted we give the interview and statements were made. I believe Mr. Hawkins Sr. is very manipulative, I believe he organized the family and orchestrated the media representation to portray himself in a better light. I do not feel safe there. I was very uneasy and nervous while I was there. I was still very disoriented, weak, and intimidated. Mr. Hawkins Sr. has also threatened me with harm based on my relationship with his daughter.   Travis Hawkins Sr. threatened me with a metal pipe while I was waiting in the car on a prior occasion.  Travis Hawkins Jr. used a metal pipe to assault me on a prior occasion.  He and his son pose a very real threat. I will not go back there.

It will be a very long time before I feel safe again. This sort of attack whether it is proven to be a hate crime or a crime derived from one man's hate of another human being should not happen to anyone in this country. No one should have to endure an attack the way that I did. Neither should a mother have to see her daughter in the state that my mom had to see me.

During this investigation, many statements were made to the media, some were premature and misguided. All of us involved have been at the center of a huge media storm. At this time, we want to let the investigation continue and we need to heal. Ally Hawkins has continued to release statements and make arbitrary facebook posts and she has even offered a motive for her brother's actions. Please know that Ally Hawkins is NOT SPEAKING for me, she is NOT representing me in the media in any way. Her statements and public posts on facebook or any other form of social media are NOT representative of my opinions, beliefs or words.

I am fortunate that my family's love for me is unconditional. I fell in love with a girl. My family loves, accepts and supports me. They have shown nothing but love and acceptance throughout my attack, my time in the hospital, and the investigation of this brutal attack, they have been there for me, loving me and supporting me. I want to thank and publicly show my appreciation for my mom, my brother and sister, my Uncle Ricky, Linda, my grandma. Besides the countless individuals who have offered their support financially and in words of kindness, I also want to thank organizations like Equality Alabama and GLAAD for offering their direct support to me and my family, as well as working to create a culture in Alabama where people aren't attacked for being who they are and loving who they love. Thank you to all those who have prayed, supported and advocated for myself and my family. For those of you who pray, we ask you to continue to pray for us as we heal.
